Client Agreement
The terms of your Swiss Prime Markets account: deposits, identity checks, withdrawals, trading, costs and disputes.
Version 1 · Last updated: October 7, 2026
This Client Agreement (the “Agreement”) is between you and Balkan Bug LLC, a Wyoming limited liability company with its registered office at 701 Tillery Street, Unit 12, Austin, TX 78702, United States, operating under the brand Swiss Prime Markets (“we”, “us”). By ticking the box when you open an account, you accept this Agreement, the Risk Disclosure and the Privacy Policy.
1. Parties, scope and your account
1.1 What we provide
We let you trade contracts for difference (CFDs) on forex, indices, metals, crypto and ETFs through our SPM Trader platform, powered by PrimeScope (web, Windows, macOS and Android). A CFD is a contract on the price change of an instrument: you never own the instrument. We are the counterparty to every trade you make.
1.2 No advice
We do not give investment, tax or legal advice. Charts, indicators, automatic Elliott Wave counts, scanners and other analysis tools are aids to your own decisions, not recommendations or signals. Every decision to trade, and its result, is yours.
1.3 Who can open an account
You must be at least 18 years old, have full legal capacity and open the account for yourself. We do not open accounts for residents of the restricted countries listed in section 4.6. You confirm that the details you give us are true, and that you will update them if they change.
1.4 Opening without documents
Your live account opens as soon as you submit the form. You receive your login details by email. You can deposit and trade at once. We verify your identity (section 2.3) before your first withdrawal, and we may ask for it earlier if the law or our risk checks require it.
1.5 One account per person
You may hold one live account opened through our website per email address. Demo accounts are separate, use virtual money only, and are not covered by sections 2 and 3 of this Agreement.
1.6 Account types
| Standard | Pro (ECN) | |
|---|---|---|
| Minimum to trade | none | net deposits of 20,000 USD |
| Spreads | standard spreads | lower spreads on forex and metals |
| Commission | none | 7 USD per lot on forex and metals |
| Maximum leverage | 1:500 (section 3.4) | 1:500 (section 3.4) |
A Pro account can deposit before it reaches the minimum, but it cannot open trades until its net deposits (deposits minus withdrawals) reach 20,000 USD. You can ask us to switch your account to Standard.
1.7 Your login
Keep your password, your investor (read-only) password and your two-factor authentication device secret. Anyone who logs in with your master password can trade on your account. We will never ask for your password by email or phone. Tell us at once at info@swissprimemarkets.com if you think someone else has access.
2. Deposits, identity checks and withdrawals
2.1 How to deposit
You deposit in USDT on TRON (TRC20), USDC on Ethereum (ERC20) or BTC. In SPM Trader you enter the amount, and we show you the exact amount to send and our address. The amount is valid for 24 hours. Send exactly that amount in one transfer, then enter the transaction ID (TxID).
2.2 When a deposit is credited
We check every transfer on the blockchain and credit it after a short review. USDT and USDC are credited 1 to 1 in USD. BTC is credited at the BTC/USD price of the minute the block with your transaction was confirmed. We do not credit:
- a transfer of a different amount, after the request expired, or sent before your request;
- a coin or network other than the one shown (such funds may be lost and cannot always be recovered);
- a transfer that we reasonably believe does not come from you or breaches section 4.4.
If you sent a transfer we cannot match, write to info@swissprimemarkets.com with the TxID. We will try to identify it, and may ask you to prove that you sent it.
2.3 Identity verification before withdrawal
Before your first withdrawal you upload in SPM Trader a valid passport or national ID card, and a proof of address (utility bill or bank statement) issued in the last 6 months that shows your name and address. The name must match the name on your account. We approve or reject the documents and tell you by email. You can upload new documents after a rejection.
2.4 If we cannot verify you
If your identity cannot be verified, or you live in a country we do not serve, we may close your account. We then return the balance, less any amounts lost in trading, only to the wallet address the funds came from, in the same coin and network, minus the network fee. We do not send funds to a new address or to a third party.
2.5 How to withdraw
You request a withdrawal in SPM Trader to your own wallet, in USDT (TRON), USDC (Ethereum) or BTC. Each request needs:
- verified identity (section 2.3);
- a code from your authenticator app (two-factor authentication), which you turn on once in SPM Trader;
- a recent login with your password.
2.6 Withdrawal limits and timing
You can withdraw up to your balance, limited by the free margin your open positions need. Minimum amounts are 5 USD (USDT), 20 USD (USDC) and 50 USD (BTC). Only one withdrawal can be pending at a time. The amount is deducted from your balance when you request it. We send it after a short review and email you the transaction ID. BTC is converted at the BTC/USD price when we send it. The network fee is deducted from the amount you receive. If we reject a request, the amount returns to your balance.
2.7 Wrong address
Check the address and network before you confirm. A transfer to a wrong address or network cannot be reversed, and we are not liable for it.
2.8 No interest, how funds are held
We pay no interest on your balance. Your balance is held in accounts controlled by us, including at third-party crypto exchanges. It is not held in segregated client accounts and is not covered by any deposit guarantee or investor compensation scheme (see the Risk Disclosure).
3. Trading
3.1 Prices
We set the buy (ask) and sell (bid) prices of each CFD from market data of third-party providers, plus our spread. Our prices can differ from prices you see elsewhere. Some instruments show delayed prices; they are marked in Market Watch and cannot be traded on a live account.
3.2 Orders and execution
You can place market orders and pending orders (buy limit, sell limit, buy stop, sell stop), with stop loss and take profit. A market order is executed at our current price when we receive it. We execute only on a fresh price: if the price feed is interrupted or the market is closed, we refuse the order and you can try again. A stop loss is not guaranteed: in a fast market or across a gap it can be filled at a worse price, at the first available price.
3.3 Market hours
Each instrument trades during its market's hours. Forex, metals and indices close for the weekend, from Friday 17:00 to Sunday 17:00 New York time. Crypto trades 24/7. While a market is closed you cannot open or close positions on it.
3.4 Leverage
Your maximum leverage is 1:500, and it is lower when your equity is higher or the risk is higher:
| Condition | Maximum leverage |
|---|---|
| Equity up to 50,000 USD | 1:500 |
| Equity over 50,000 up to 200,000 USD | 1:200 |
| Equity over 200,000 USD | 1:100 |
| Forex, metals and indices, Friday 15:00 to Sunday 17:00 New York time | 1:200, also for open positions |
| New positions around high-impact news | 1:100 |
Some instruments have their own lower limit, shown in SPM Trader. We may change leverage for risk reasons, and we will show the current value in the platform.
3.5 Margin and stop-out
Every open position needs margin. Margin level = equity divided by used margin, in percent. If your margin level falls to 50% or lower, we start closing your positions at the current price, beginning with the one losing the most, without asking you, until the margin level is above 50%. Watch your margin: we do not have to warn you first.
3.6 Negative balance protection
You cannot lose more than the money in your account. If a fast market move or a price gap leaves your balance below zero once all your positions are closed, we reset it to zero at our cost and you owe us nothing. This does not apply where the negative balance results from a breach of section 3.8.
3.7 Errors
If a trade was executed at a price that was clearly wrong because of a feed or system error, we may correct or cancel it and tell you why. We do so within a reasonable time and in good faith.
3.8 Prohibited conduct
You may not:
- exploit delayed or wrong prices, latency or platform errors;
- use the account for money laundering, fraud or financing of terrorism;
- trade with funds that are not yours, or let another person use your account;
- use robots or tools that overload or attack the platform;
- coordinate trading between accounts to abuse our pricing.
If we reasonably believe you broke this section, we may cancel the affected trades, refuse deposits or withdrawals while we investigate, and close your account.
3.9 The platform
We provide SPM Trader as it is. It may be unavailable at times, for example during maintenance or an outage of a data provider. We are not liable for losses caused by your device, your internet connection, or a third-party service outside our control.
4. Fees, liability, ending the agreement, disputes
4.1 Costs
Our costs are the spread on every trade, the commission on Pro accounts (section 1.6) and blockchain network fees on withdrawals. We do not charge deposit, withdrawal or inactivity fees, and we currently charge no swaps or overnight financing on open positions; if we introduce them, we will tell you under section 4.8 before they apply. Premium analysis tools are included free once your net deposits exceed 2,000 USD.
4.2 Statements
Your positions, trade history, deposits and withdrawals are available in SPM Trader at all times. Check them regularly and tell us of any error within 7 days.
4.3 Our liability
We are liable for losses caused by our gross negligence, wilful misconduct or fraud. We are not liable for trading losses, lost profits, or losses caused by market movements, events outside our control (outages of exchanges, blockchains, data or hosting providers, war, sanctions, changes of law), or by your breach of this Agreement. Where the law allows, our total liability to you for any claim is limited to the balance of your account when the claim arises.
4.4 Compliance checks
We may ask for information about you and the source of your funds at any time, and refuse or delay a deposit, trade or withdrawal while we check. We may report suspicious activity to the authorities where the law requires it, without telling you.
4.5 Suspension and closing
You may close your account at any time by writing to info@swissprimemarkets.com, after closing your positions; we pay out your balance under section 2. We may suspend or close your account with notice, or at once if you break this Agreement, if we cannot verify you, or if the law requires it. Open positions may then be closed at the current price.
4.6 Restricted countries
We do not offer services to residents of the United States, or of countries subject to comprehensive United Nations, European Union or United States sanctions. The country list in the account form shows where we accept clients, and we may add countries to the restricted list. You must not use a VPN or false details to hide where you live. If you move to a restricted country, tell us; we may then close your account under section 4.5.
4.7 Complaints
Send complaints to info@swissprimemarkets.com with your account number. We confirm receipt within 2 business days and answer within 15 business days.
4.8 Changes
We may change this Agreement. We publish the new version on our website and tell you by email at least 14 days before it applies, unless a change is required by law or is in your favour. If you do not agree, you may close your account before the change applies.
4.9 Governing law and disputes
This Agreement is governed by the laws of the State of Wyoming, United States, and disputes are decided by the competent courts of the State of Wyoming. Nothing in this section removes mandatory consumer protection rights you may have where you live.
4.10 Notices and language
We contact you by email at the address on your account and in SPM Trader. This Agreement is written in English; a translation, if any, is for convenience only.
